AND UPON the Order with Reasons of SCT Judge Delvin Sumo dated 15 December 2023 (the “Order”)

AND UPON reviewing the Defendant’s Application Notice dated 17 April 2024 seeking to set aside the Default Order (the “Application”)

AND UPON a hearing having been held before me on 16 May 2024 with the Claimant and the Defendant’s representative in attendance

AND UPON reviewing the court file and documents contained therein

AND PURSUANT TORules 53.34 of the Rules of the DIFC Courts (“RDC”)

IT IS HEREBY ORDERED THAT:

1. The Application is granted.

2. The Default Order and the Order shall be set aside.

3. Reasons for this Order shall follow.

4. A hearing of this Claim shall be listed by the SCT Registry.

5. Each party shall bear its own costs.
